This contract for sale made this by and between Emmy Steagall and or Tn Saints and (buyer), herein after known as Breeder and herein after known as Buyer. This is a contractual agreement for the ownership of one (male/female) Saint Bernard puppy, whelped on date, Dam- Steagall’s Miss Paris TN AKC WS12729307and Sire- XXXXX. Buyer wishes to purchase the above-described puppy for the sum of $XXXXX. AKC limited registration application will be released upon full payment and written proof of spay or neuter. A spay/neuter agreement is required with a limited registration.

Breeder guarantees that the above-described dog is a purebred Saint Bernard and can be registered with the AKC. Breeder agrees to provide a photocopy of this dog’s AKC application and a photocopy of a five-generation lineage for both Sire and Dam. Once Breeder receives proof of spay/neuter you will receive the official limited AKC application that will allow the puppy to be registered with the AKC. Your puppy should be spay/neutered before 8 months of age. The AKC will charge an extra fee to register your puppy if it is not registered within one year of the whelp date. Buyer & Breeder agree to enter into this contract under the following binding agreement:
1) Breeder warrants the puppy sold to be in good health at the time of delivery. Puppy has been given its 1st round of inoculation on and has been wormed with Strongid-T a minimum of 3 times. If the health of this puppy is found to be unsatisfactory within 72 hours of purchase, the puppy may be returned for a full refund limited to the purchase price of the puppy. Delivery fee or pick up expenses will not be reimbursed. If this animal should fall ill please contact the Breeder immediately at 931.205.5612.
2) Buyer agrees to provide safe guards for this dogs well being, including but not limited to, proper diet, obedience, proper socialization, shelter, exercise, companionship, veterinary care. Buyer also agrees that this dog will not be tied or chained in any way, unless briefly, or allowed to roam free, but will be supplied a fenced yard, large kennel, or proper outdoor supervision.
3) Buyer agrees that if at anytime the dog can no longer reside with her/him, breeder will be given first option to take back the dog, no monetary compensation is given. If breeder cannot take the dog, a mutually agreed upon home will be found. This dog will not be surrendered to any animal shelter.
4) Buyer hereby releases breeder and agrees to hold harmless for any and all liability, injuries or damages to persons or property caused by this dog.
5) Any litigation arising from this sale will take place in Marshall County, in the State of Tennessee.
6) Health Guarantee beyond 72 hours is to be limited to a puppy replacement. The owner may keep the original dog but it must be spayed or neutered and the AKC registration is to be turned over to the breeder with a copy of spay/neuter certificate. Purchaser will be supplied a new pup of equal quality from the breeders next available litter, or whenever purchaser desires replacement puppy. No monetary reimbursement will be given unless agreed upon by both breeder and puppy purchaser. No veterinary expenses will be reimbursed.
Description of Guarantee: Dog is guaranteed to be free of serious genetic defects i.e. Organ defects, epilepsy, von Wildebrands disease, absence of sight or hearing. Said dogs hip conformation will not be evaluated as worse than mild dysplasia by the OFA(Orthopedic Foundation for Animals) for up to 18 months of age of said dog.

Spay/neuter Agreement For Pet/companion Dogs
The seller/breeder guarantees this dog is a purebred Saint Bernard that can be registered with AKC. The breeder will hold registration papers until written proof of spay or neuter has been received.
* This puppy is sold as a pet with limited AKC registration papers. Which means that although this dog is purebred and AKC registered, it should not be used for breeding or conformation showing purposes. It is not eligible to show and none of its off spring could be registered with AKC. Buyer(s) agree to have this puppy spayed/neutered by the age of (8) months. *SPAY/NEUTER AGREEMENT AND RELATED PENALTIES Buyer understands the above dog is NOT to be bred at any time, on purpose or by accident, and is to be neutered/spayed between the age of 8 months and 12 months, as specified below. It is understood this dog is being sold to BUYER with a Limited Registration. A dog registered in such a way is AKC registered, however any offspring resulting from the breeding of this dog, on purpose or by accident, is not be eligible for AKC registration. *Resulting Offspring/Penalties for Breeding Breeding this dog is considered BREACH OF CONTRACT. BUYER understands the penalties as follows for breeding, by accident or on purpose, this dog in violation of this agreement: BUYER will pay SELLER $1800 for each litter produced by this dog.
This contract contains the entire agreement between the parties and no statement or verbal agreements made by either party that are not contained in this written contract shall be valid or binding.
